Key Points:

The Pentagon retaliated against Anthropic for protected speech and violated its due process rights, according to the 59-page order a San Francisco federal judge issued yesterday evening. The order calls the measures imposed on the company illegal and baseless and says officials wanted to make a public example of it. The designation had cut off a July 2025 contract worth $200 million that put Claude on classified government networks. Government lawyers are expected to appeal, and a separate Pentagon designation is still being fought in Washington.

OpenAI signed its own defense agreement within hours of the blacklisting, and ChatGPT uninstalls jumped 295% in the weeks that followed, so users were already voting on where the line should be drawn. The ruling adds that a lab can write that line into its own terms and expect it to hold up against the government, which makes the refusal list in a usage policy worth more than any safety page. Anthropic had those limits in writing, and refusing to remove them is what started this fight.

Cloudflare, CrowdStrike and Palo Alto Networks are the vendors expected to sell whatever spending this 128 name letter produces, and all three signed it. The document blames longstanding bugs and technical debt in legacy systems for the exposure, listing excessive permissions, weak authentication and unpatched software among the weaknesses it wants closed. Governments are asked to bankroll defence for essential services with no budget of their own and to impose real costs on the attackers going after them.

Anthropic signed this letter after disclosing last November that a Chinese state backed group had steered Claude Code through roughly thirty intrusion attempts and succeeded at several. Anyone who depends on a hospital or a water utility is relying on defenders the letter admits have been under-resourced for years, and those defenders are the ones now expected to move fastest against attackers using AI to speed up.
